How Donald Trump is trying to save TikTok

Will TikTok be banned in the United States in January? This is the question that users of the social network are asking themselves. This law was signed by Joe Biden and provides for the ban to be applied from January 19.

But nothing is lost for TikTok yet. Indeed, the case is now in the hands of the United States Supreme Court. And moreover, during his electoral campaign, Donald Trump declared, in a video,that he will “save TikTok”. The problem is that the law provides for the banning of the social network just before Trump's inauguration.

Donald Trump calls for a suspension of the law

According to our colleagues at TechCrunch, Donald Trump's lawyers have filed a document with the Supreme Court explaining why the application of this law should be postponed.

“The statutorily mandated 270-day deadline expires on January 19, 2025, one day before President Trump takes office as the 47th President of the United States.”, explain Donald Trump's lawyers.“This unfortunate timeline interferes with President Trump's ability to manage U.S. foreign policy and pursue a resolution aimed at both protecting national security and saving a social media platform that provides a popular vehicle for 170 million Americans to exercise their fundamental First Amendment rights.”

In other words, Trump would like the Supreme Court to suspend the ban on TikTok, so that his new administration has time to resolve this problem after the inauguration. This argument had already been used by TikTok to request a suspension of the ban from a Federal Court. TikTok had explained, in its request, that an injunction“will give the incoming administration time to determine its position, which could negate both the impending harm and the need for Supreme Court review.”However, this Federal Court addecided not to prevent the ban.

Otherwise, it should be noted that the United States Supreme Court is already handling the case. She will be able to hear TikTok's arguments on January 10.
