DMA: insufficient measures? EU scrutinizes Apple

Brussels has just announced several investigations for non-compliance, which concern Apple, Google, and Meta.

As expected, the European Union will investigate to determine whether the companies about which it has doubts have complied with the DMA or not. The new laws on EU markets have been in effect since March 7, but some of them have not convinced European commissioners. The DMA changes discussed here are those made by Applein iOS 17.4.

5 open investigations

European Commissioner Margrethe Vestager, who seems to be in the spotlight regarding the DMA, announced the news this morning in apublication[X].

Today we are opening the 1st #investigations under the #DMA. We are concerned that #Alphabet, Apple and Meta are not meeting their obligations, for example: Apple and Alphabet still charge recurring fees to app developers. Meta does not provide a real choice for users to opt out of data combining.

The opening of these investigationswas plannedand follows the EU's study of compliance reports provided by Alphabet (Google), Amazon, Apple, ByteDance, Meta and Microsoft regarding the DMA. In a paper on the subject, the commission also mentions having collected “stakeholder comments» to clarify the situation. We imagine that some of Apple's competitors did not hesitate to directly denounceApple's lack of effortto formally comply with the rules.

The EU will now verify “if Apple's new pricing structure does not make it de facto attractive to use the DMA benefits.» If this is not the case, Apple risks new sanctions.

The commission is not convinced

In a press release, the other figure of the DMA, Thierry Breton, declared:

“We are not convinced that the solutions proposed by Alphabet, Apple and Meta meet their obligations towards a fairer and more open digital space for European citizens and businesses. — If our investigation concludes a lack of full compliance with the DMA, access controllers face heavy fines. »

TheApple spokespersonJulien Trosdorf told TheVerge on this subject that Apple's plan was consistent with the DMA, and that Cupertino will continue to collaborate "constructively» with the European Commission, «throughout his investigations».

In addition to this investigation, the Apple firm is also engaged ina historic trial against American justice, for a few days.
