The battlelegal between Samsung and Applejust took
a new turning point with Samsung's recent decision.
Indeed, while the two companies face each other in court
around the world for months, it was in the US that Samsung decided to
attack withwith the aim of prohibiting the importation of
some iPhone and iPad models.
The decision has just been made and it is in favor of
Samsung :
As usual, it is because of a patent held by Samsung that the
conflict is born. Samsung claims that Apple infringes one of its patents by
marketing the iPhone and iPad. The court ruled in favor of the firm
Korean, prohibiting the importationiPhone 4s sold at
AT&T(uniquely). This therefore has an impact because if Apple is a
American company, it imports its products from China and such
ban therefore makes it impossible to sell the products in
question.
According to patent expert Florian Muller, the decision in favor of
Samsung is a surprise. According to him, as the patent in question concerns a
basic function of the smartphone, its owner would be obliged to give up
a license to anyone who requests it on "equitable bases and not
discriminatory", a classic for this type of patent.
Still according to the same expert, Samsung could reserve the right
to extend its complaint to all iPhone or iPad models equipped with a chip
de communication mobile.
Obviously, the Cupertino company decided to appeal while
according to US law, the American president also has the power to cancel
the decision: he has 60 days to do so. It will be noted that
his government had just published a recommendation to Congress the day before
asking to limit the ITC's import ban power
