Senators have just voted on a provision of the very controversial Justice bill. Concretely, it authorizes the triggering of cameras or microphones, the geolocation of telephones and computers as part of investigations relating to terrorism and organized crime.
“A security escalation”
The Minister of Justice, Eric Dupond-Moretti, for his part, wanted to defend this project. According to him, these techniques are already applied by the police. Except that they endanger investigators by forcing them to install beacons, microphones, or cameras. The minister also affirms that this procedure presents“important guarantees”. For example, it must receive approval from a judge.
But this was clearly not enough to calm the opposition, and in particular the left, which demanded additional protections, particularly for certain professions: journalists, lawyers, magistrates, and parliamentarians.
The fight is not lost, however, for all those who challenge this text. Indeed, the project remains examined in the Senate and it will then shuttle between the two assemblies. If it ends up being voted on, there is a good chance that the Constitutional Council will be referred to it.
Remember that this law is highly contested by certain human rights defense associations. Thus the Observatory of Freedoms and Digital (OLN)estimatedthat some of the offenses concerned“have already been used to pursue militant actions”, particularly from environmentalists or support for migrants. And the organization accuses the government of “security overbidding. »
