Apple launched an offensive in 2011
against Samsung for patent infringement and copying of its products, after which we
known since 2010 to have tried to find an agreement with the Korean. The trial
in the US, which we followedparticularly via the
often indiscreet internal documents and other prototypes shown by both
gone, has just seen its outcome this night, after the one which took place
in Korea, whose verdict fell yesterday anddiscussed
(apparently in the comments) right here.
After 3 days of deliberations,Samsung is recognized
guiltyof having willfully infringed Apple's patents and
for having copied the design of the iPhone:
Samsung is ordered to pay damages in the amount of1,05
billion of dollars. Conversely, Korean is not recognized
guilty regarding a possible copy of the iPad with its models
Galaxy.
The verdict fell ahead of what the specialists
were waiting. In total, 25 Android smartphones are believed to be involved. THE
details of the patents infringed and the mobiles concerned are available
here at Cnetet
the verdict is available here
The jury of 9 people after hearing the testimonies of the belligerents
and their witnesses for almost three weeks completed a document of 20
pages covering 700 questions for which guilt or not was
decided. Apple initially demanded more than $2 billion.
In detail, all Apple patents, particularly on the iOS interface, have
been recognized as valid.
However, the matter is not over and Samsung can and will certainly
appeal. It is not yet determined whether certain Samsung products
must be withdrawn from sale. Regardless, Apple is not going to touch
money before long but has already won an important victory
praised by Tim Cook
in a message to Apple employeesemphasizing values beyond
money and patents. For Apple, this victory is above all the ability to
show mobile manufacturers including Google and Android implicitly that it
there is no impunity in copying, probably what Apple was looking for before
everything for its future products more than for past products.
We will follow the decisions resulting from this verdict and the choices of the lawyers of
Samsung in the days to come. In any case a nice gift for the first
Tim Cook's birthday at the head of Apple!
Update: the judge will rule on September 20 on a
possible ban on the sale of certain Samsung mobiles in the US.
