It has been a long day for the apple brand's lawyers. If the latter have had an unenviable schedule in recent months with trials all over the world, the historic legal decision of the court of Bogota in Colombia could almost sign the final blow.
But even on its knees, the apple brand wants (and can) defend itself. As a reminder in this case, the courts of the South American state concluded that Apple had benefited from invention patents belonging to another competing brand. In the specific case of the Colombian case, it is a question ofthe Swedish firm Ericsson.
Apple simply banned from selling its latest iPhones
While Apple expected a harsh verdict, no one imagined that Colombian justice could go this far. In a country where iOS is the second most used operating system, with almost 12% of the population, Colombia has decided to do without it.
Indeedthe verdict makes it illegal to sell iPhones or iPads with 5G modems. All of Apple's most recent devices are put out of service by this court decision. Obviously, such a verdict made the lawyer in charge of the case for Apple jump out of his chair, who immediately asked that this court decision be reviewed during the appeal.
If a second trial were to take place in the coming months, many specialists in the Colombian jurisdiction assure that the facts are there and that the verdict will be close, if not identical. Little by little understanding that the Colombian justice system will not plead in its favor in this case, the Apple is trying new methods to turn things around to its advantage.
A decision that could appeal to others
The Cupertino company has just ruled that this decision was “a violation of civil rights”. If this accusation is unlikely to change anything, the apple brand is trying to save its image and now fears that this historic court decision will serve as a precedent in other countries.
Because on the other side of the bar, Ericsson is enjoying it. The Swedish company knows that this court decision will not change much, buta similar trial is underway in the United Kingdom. This too could, in the worst case scenario for Apple, withdraw from sale all devices with a 5G modem.
