European commissioners never stop putting obstacles in the way of web giants. For several months, it has been a festival of new restrictive laws in Brussels. The DSA (Digital Service Act), which has been debated since October 2022 in the European Parliament, is now active.
Many oppositions
Thierry Breton, who is in charge of the file, spoke to Franceinfo on this subject for the occasion. According to him, the DSA “is anything but the ministry of censorship”. This statement follows the numerous oppositions expressed by Internet users to this new regulation. GAFAM is also against the DSA, describing these measures as being contrary to the foundations of the internet.
Companies concerned and objectives
The DSA affects all players offering online services within the territory of the European Union. However, the implementation of the text on August 25 does not affectthan the big guys on the market, described as a “gatekeeper” by European commissioners.
As a reminder, these are companies withover 45 million users in the EU. Apple, X, and even Facebook are targeted. Oddly, Telegram is falling by the wayside and is not considered one of these “gatekeepers”. The other players have several months to comply. As far as they are concerned, the implementation of the DSA is scheduled for February 17, 2024.
Furthermore, the DSA mainly aims tostrengthen control of disinformation and illegal content online. From today, the platforms concerned will have 24 hours to moderate illegal content, under penalty of heavy penalties of up to 6% of their turnover. The law also requires them to disclose how their advertising algorithms work to the general public, for transparency purposes.
What changes for Apple?
The Apple firm is of course targeted by this law, in particular with the App Store. But the one that really concerns Apple is the DMA (Digital Market Act), another regulation which will notably force the company to establish thesideloadingon all its devices. As a reminder, this DMA law will only be effective onSeptember 6, 2023. From there, Apple will have 6 months to comply with the text.
