A judge rejects a pursuit of antitrust against the app store

It’s a decision that could be a landmark. An antitrust lawsuit filed by Blix against Apple has been dismissed by a federal judge in Delaware. As a reminder, BlueMail was removed from the Mac App Store in June 2019 when Apple found that the application violated several of its regulations, notably those related to data security. A few days later, the app was back.

A precedent for future trials?

This did not prevent Blix from filing a complaint accusing Apple of modifying the search results of its App Stores on iOS and macOS to favor its services over those of the competition. The company also accuses the Apple brand of having copied one of its patented technologies by launching its “connect with Apple” function.

These arguments did not convince Judge Leonard P. Stark who considered that Blix did not provide the necessary evidence concerning the monopoly or the anticompetitive conduct of the Cupertino firm:

Claims that Apple has the power to restrict competition are not equivalent to evidence that the company actually restricted competitors' production. Even if Blix had plausibly alleged that Apple had an app monopoly, its failure to prove anticompetitive behavior provides reason to dismiss its accusations.

Each case is of course different but we can imagine that this decision could create a precedent. Apple is subject tonumerous lawsuitsantitrust in the United States andin the rest of the worldand this success is therefore rather encouraging for the apple brand.
