While Samsung and
Apple has been fighting in court for more than two years before several
jurisdictions in the world, we rememberof the trial
won by Apple in the United Statesaccompanied by a fine of 1 billion
dollars to be paid by Samsung.
The latest judgment in this case, the judge announced yesterday that
Samsung did not intentionally infringe the patents
d’Applecutting short an increase in the fine, but specifying
also that nothing justified the holding of a new trial contrary to
what Samsung asked for.
On this occasion, Samsung's defense appeared rather surprising
…
For the judge, Apple failed to gather enough evidence to
demonstrate that Samsung intentionally infringed its patents. If this had not
not been the case, it is very likely that the already astronomical sum of1 billion
dollarsthat the Korean must pay to Apple would have been reassessed.
For its part, Samsung has put forward an argument during these latest hearings
odd. Indeed, the manufacturer claims that it had good reasons to
believe thatthe patents in question were invalid and had no
therefore no intention to harm Apple…by ignoring them purely and
simply. Except that these patents were not invalidated by the judge.
But another important decision in this clash of titans is
also fell yesterday.
The judge in factrejected Samsung's request to organize a
new trial. According to her, the one held this summer was
just.
