René Repasi, the German socialist MEP and rapporteur of the text, presented the directive adopted by a very large majority by the European Parliament on Tuesday April 23.
The idea is therefore to strengthenthe right to repairfor consumers on products such as smartphones and other electronic devices. This new text thus provides for strengthening the guarantee on these products. While it is currently two years, this period will be extended by one year if repairs have been undertaken during the first two years.
Anti-Apple measures?
Likewise, the directive intends to put an end to contractual barriers to repair. Manufacturers are therefore required to update“available, and at a reasonable price, the products necessary for the repair. For example, removing the warranty if you repair with a non-contractual part, or setting up excessive costs to be able to access the tool that will allow the repair, will no longer be appropriate.
The EU also intends to put an end to“hardware or software techniques hindering repairs. In particular (manufacturers) will not be able to prevent independent repairers from using second-hand or 3D printed spare parts, nor refuse to repair a product solely for economic reasons or because it has previously been repaired by someone else. another ».
Asked whether these measures are in contradiction with trade policypracticed by Apple,the MEP does not deny:“If an independent repairer opens an iPhone today with his own tools, and not Apple tools, or if he does not use original parts, the consumer loses his Apple guarantees. Some applications then no longer work ».
Incentives for consumers
He adds:“This type of barrier will normally be prohibited under the Right to Repair Directive. Apple will have to prove that it is absolutely necessary to maintain this barrier to protect its intellectual property, which should not be so simple, and which will certainly end up in court. These practices should be considered, in my opinion, as illegal”.
Finally, note that the directive provides for the establishment of repair incentives, such as vouchers that can be spent at local repairers and stores that sell reconditioned products.
