Apple declares victory…and appeals
Obviously, Apple doesn't want to give up anything. Despite a victory that seems resounding in thelawsuit against Epic Games, Apple does not feel satisfied and decides to appeal. Indeed, in its verdict announced on September 10, the court recognized that Apple was not in a monopoly position. But at the same time, however, she issued an injunction to the Californian company to allow third-party developers to contact their users directly to circumvent the 30% commission from iOS. And that's not all: Apple must also integrate an alternative payment solution into its App Store.
Normally, this injunction must take effect from December 9, 2021. This means that the Cupertino company has until this date to modify the sales policy of its App Store. However, the brand has decided to appeal and requests a suspension of this permanent injunction, at least until the appeals filed by both parties are resolved.
The Court presided over by Judge Yvonne Gonzales Rogers decided to schedule a hearing to hear the appeal intended to suspend the injunction for November 9. Note that Epic Games has objected to this suspension request, believing that Apple should not be entitled to it. For its part, Apple claims to understand and respect the concerns of justice regarding communications between developers and users. But the firm wants to protect not only the operation of its platform, but also the security and privacy of its customers.
It is impossible to know if Fortnite will one day return to the App Store: the fate of the game from the Epic Games studio is still not fixed. However, it is one of the most popular platforms across all devices. For now, those who installed the app before Apple removed it from iOS can still play it. But for how long?
