Competition law: Spotify could win against Apple

For several months now, justice has seen two tech giants clash in Europe: Apple and Spotify. At the origin of the affair, the second who accuses the first of anti-competitive behavior. For what ? Quite simply becausethe App Store charges a 30% commission on each purchase made from iOS. If the story reminds you of something, that's normal: it's alsothe rather shaky argument made by the publisher of Fortnite.

Despite everything, many analysts - and even the media, for that matter - consider that this is only a rather exaggerated request, far from convincing the leaders of our continent and even with more and more no more detractors at the helm. Which, however, is not the opinion ofFlorian Müller, developer whose opinion was relayed this week by9to5Mac.

It's over

Indeed, according to the coder, Apple has still not succeeded in demonstrating thelack of dominant positionof its share in the mobile apps sector. In the same way, its Music service, therefore a competitor to Spotify, would continue to benefit from a privileged framework compared to other music streaming platforms. Enough to bend legislators?

According to him, the answer is simple: yes. The expert even states thatthe App Store monopoly is over in Europe. Although clear and sharp, his testimony nevertheless remains nuanced. Indeed, Müller also has an interest in defending this point of view since he designs applications himself. It is therefore difficult, at least for the moment, to predict what will happen at the end of this affair.

Jurisprudence ?

If in the end Apple loses against Spotify with theEuropean Commission, then this would be a historic decision. Many EU member countries are trying (as best they can) to follow the resolutions adopted by the highest authorities. Even in France where autonomous cars are still not allowed to drive, the verdict could cause some noise.

To date, a subscription to the Swedish service costs 9.99 euros per month for a single user. There is also a plan dedicated to families, this time billed at 15.99 euros per month. As for the most accessible offer, it targets students: 4.99 euros monthly,as for Disney+ series and films.
